Early Evidence Review for Virginia DUI Charges

A DUI arrest calls for a prompt review of the traffic stop, testing procedures, and evidence the Commonwealth intends to use. At Bush & Taylor, P.C., we defend people charged in Virginia Beach by examining the case against them and explaining what to expect in court.

Our Suffolk DWI attorneys have more than 15 years of experience defending these charges, including difficult cases. We handle criminal defense matters throughout Virginia Beach and represent adults as well as drivers accused of underage DUI.

How We Evaluate a DUI or DWI Charge

Our evaluation begins with your account of the traffic stop, arrest, and testing process. We then review the charging documents and assess the strength of the prosecutor’s case rather than treating the arrest as proof of guilt.

Evidence questions often concern the legal basis for the stop, the officer’s observations, arrest procedures, and chemical testing. We review reports from the arresting agency, available video recordings, and Department of Forensic Science records for weaknesses or inconsistencies in the Commonwealth’s evidence.

Our review may address:

  • Whether the officer had a lawful basis to stop the vehicle
  • What body-camera, dashboard-camera, or other video evidence shows
  • Whether arrest and testing procedures were properly followed
  • Whether forensic records support the alleged test result

Depending on the facts and applicable law, we may file a motion asking the court to suppress evidence obtained in violation of a defendant’s legal rights. We may also negotiate with the Commonwealth’s Attorney, although the available course of action depends on the evidence and procedural history of each case.

Virginia DUI & DWI Legal Standards

Virginia Code Section 18.2-266 makes it unlawful to drive or operate a motor vehicle with a blood alcohol concentration of 0.08% or higher. Blood alcohol concentration measures the amount of alcohol in a person’s bloodstream. The statute also addresses specified blood concentrations of PCP, cocaine, methamphetamine, and MDMA.

A test result is only one potential part of the prosecution’s evidence. The case can also involve the circumstances of the stop, the officer’s observations, statements, video, and the procedures used to collect or analyze a chemical sample. A drunk-driving lawyer serving Virginia Beach can review how those components relate to the allegation.

Consequences of a First DUI Conviction in Virginia

A first conviction under Virginia Code Section 18.2-266 is generally a Class 1 misdemeanor unless another provision applies. The statute requires a minimum $250 fine, and a Class 1 misdemeanor can be punished by up to 12 months in jail.

Elevated blood alcohol concentration results can require incarceration. A result from 0.15% through 0.20% requires at least five days in jail. A result above 0.20% requires at least 10 days.

The court also imposes license revocation following a DUI conviction as authorized by Virginia Code Section 18.2-271. Transporting someone age 17 or younger during the offense adds a fine of $500 to $1,000 and at least five days of confinement. Determining which consequences apply requires an examination of the charge, evidence, and relevant history.

Repeat DUI Offenses & Felony Allegations

Virginia penalties escalate when a person has qualifying prior convictions. A second DUI committed less than five years after a prior offense requires a minimum $500 fine and a jail sentence. A second offense occurring five to 10 years after the prior offense carries the same minimum fine but a shorter required jail term.

A third DUI offense within a decade is a Class 6 felony. The statutory penalties include at least 90 days of incarceration and a $1,000 fine. When all three offenses occurred within five years, the required sentence increases to six months.

A fourth or subsequent DUI offense within a decade is also a Class 6 felony. It requires at least one year of imprisonment and a $1,000 fine. Because these escalation rules concern qualifying convictions, the dates and legal status of the alleged prior offenses must be reviewed carefully.

The DUI Court Process in Virginia Beach

First and second DUI offenses arising in Virginia Beach are heard in Virginia Beach General District Court, which designates Traffic Courtroom C for DUI-related matters. A third offense within 10 years is a felony handled in Circuit Court.

At arraignment, the judge advises the defendant of the charge, takes a plea, addresses bail or bond, and schedules a later hearing. The court doesn’t hear evidence or decide guilt at this stage. Immediate concerns can include bond, upcoming court dates, and driving consequences, all of which require case-specific review.

A conviction in General District Court may be appealed to Circuit Court. The Circuit Court proceeding is heard de novo, meaning the case is heard again rather than reviewed only for an error in the earlier proceeding. We guide clients through the applicable court process and explain consequential decisions as the case develops.
